MODEL PROFILES AND PROFESSIONAL MATERIALS

The Website may contain photographs, videos, measurements, professional biographies, portfolios, comp cards and other materials relating to Models represented by Noemi.

Model profiles are provided for legitimate representation, casting and professional promotional purposes.

The appearance, measurements, availability and professional information of Models may change, and Clients should obtain current information from Noemi before relying on Website information for a Booking or casting decision.

Publication of a Model on the Website does not constitute a guarantee that the Model is available for any particular date, location, project or use.

All professional Booking enquiries should be directed through Noemi using our official contact channels.

MODEL APPLICATIONS AND REPRESENTATION

Where Noemi makes an application or scouting process available through the Website, applicants must provide information that is accurate and truthful.

Noemi currently accepts applications from and represents individuals aged 18 and over only.

You must not:

  • falsely state that you are 18 or over;

  • provide a false date of birth;

  • impersonate another person;

  • submit another person's photographs without authority;

  • provide materially false measurements or professional information; or

  • deliberately conceal an existing agency relationship or contractual restriction where relevant to an application.

Submission of an application does not guarantee:

  • representation;

  • a meeting or interview;

  • model development;

  • inclusion on the Website;

  • a Booking;

  • a casting; or

  • Placement with another agency.

Noemi retains professional discretion regarding whom it considers, interviews, develops or represents.

SCOUTING AND FRAUD PREVENTION

Noemi may contact prospective Models through official Agency channels or authorised members of the Noemi team.

Noemi does not charge an upfront fee simply to apply for representation.

You should exercise caution where anyone claims to represent Noemi and:

  • requests payment in exchange for an application or guaranteed representation;

  • asks for intimate or sexually explicit photographs;

  • requests passwords or login credentials;

  • requests inappropriate personal information;

  • pressures you to attend an unsafe or undisclosed location; or

  • communicates in a manner inconsistent with our official channels.

If you are unsure whether a communication is genuine, contact Noemi directly through the contact details published on this Website before taking further action.

CLIENT AND BOOKING ENQUIRIES

Clients and professional contacts may use the Website to identify Models, contact Noemi and make professional enquiries.

No Booking shall be treated as confirmed merely because:

  • a Model appears on the Website;

  • an enquiry has been submitted;

  • a Model has been shortlisted;

  • rates have been discussed;

  • availability has been requested; or

  • preliminary communication has taken place.

A Booking becomes binding only in accordance with the applicable Booking confirmation, agreement or other terms agreed between the relevant parties.

Noemi reserves the right to decline an enquiry or proposed Booking where it considers the opportunity inappropriate, unsafe, unlawful, commercially unsuitable or inconsistent with a Model's agreed professional boundaries.

INTELLECTUAL PROPERTY

The Website and its content may include:

  • Noemi branding;

  • logos;

  • text;

  • graphic design;

  • layouts;

  • photographs;

  • videos;

  • Model profiles;

  • comp cards;

  • portfolios;

  • creative materials; and

  • other intellectual property.

Copyright and other intellectual-property rights belong to Noemi or the relevant photographer, videographer, Model, Client, designer, licensor or other lawful rights holder.

Nothing on the Website transfers ownership of intellectual property to Website visitors.

Unless expressly permitted by the relevant rights holder, you must not:

  • distribute;

  • sell;

  • commercially exploit;

USE OF MODEL IMAGES

Images of Models displayed on the Website are provided for legitimate Agency representation and professional promotional purposes.

You may not download, copy, scrape, reproduce or use Model photographs or videos for:

  • commercial campaigns;

  • artificial intelligence training;

  • dataset creation;

  • biometric databases;

  • impersonation;

  • deepfakes or synthetic media;

  • pornography or sexualised content;

  • misleading endorsements;

  • unauthorised social-media accounts; or

  • any other commercial or exploitative purpose

without the appropriate permission from the relevant rights holder and, where applicable, the Model and Noemi.

Professional enquiries concerning image usage should be directed to Noemi.

PERMITTED USE OF THE WEBSITE

  • making legitimate Client or professional enquiries;

You must not knowingly use or attempt to use the Website:

Automated access to the Website for the purpose of systematically collecting, copying or extracting Model information, photographs, videos, profiles or other Agency content is not permitted without prior written authorisation from Noemi or the relevant rights holder.

Website content may not be used without appropriate permission for:

  • training or developing artificial intelligence systems;

  • facial-recognition systems;

  • biometric analysis;

  • synthetic image or video generation;

  • dataset compilation; or

Nothing in this Clause restricts uses which cannot lawfully be restricted.

I prefer this wording to the old blanket “you indemnify us for everything” clause. A very broad indemnity against ordinary Website visitors can be unnecessarily aggressive and may be vulnerable depending on the circumstances.

Noemi may restrict or block access to the Website where reasonably necessary to:
